La paz traicionada

El 6 de junio de 1957, en un suburbio del sur de Bogotá, cayó muerto Guadalupe Salcedo Unda. El Capitán, como se le conoció a Guadalupe, había sido el jefe máximo de las guerrillas liberales del Llano, un ejército de más 5000 campesinos levantados en armas contra la violencia conservadora tras el asesinato del caudillo liberal Jorge Eliécer Gaitán. Tres años antes, Guadalupe había firmado un acuerdo de paz con el gobierno del general Rojas Pinilla, acuerdo que incluía, aparte de la entrega de las armas, una amnistía general para los guerrilleros, así como reformas sociales y económicas en los territorios ocupados por los alzados en armas. Guadalupe Salcedo fue asesinado a mansalva por agentes de la policía, cuando ya se había incorporado a la vida civil y política. En el momento de su muerte acababa de salir de una reunión con antiguos compañeros suyos, evaluando estrategias conducentes a lograr el cumplimiento del acuerdo de paz celebrado.
Es probable que todavía muchos colombianos desconozcan el significado de toda esta historia: la muerte de Guadalupe vendría a sellar la traición del establecimiento no sólo al acuerdo celebrado con el jefe guerrillero, sino también a las expectativas de reformas sociales de miles de campesinos que se habían levantado en armas por la tierra y la paz. Desde entonces, el incumplimiento de los acuerdos celebrados, la felonía y el asesinato de dirigentes sociales y políticos de oposición se convirtió en un patrón de conducta de las clases y partidos dominantes en Colombia, marcando con ello una tradición que explica buena parte de la tragedia nuestra, detrás de la cual se esconden los intereses de aquellos sectores que viven del atraso y el conservadurismo cultural, social y político de la sociedad colombiana.
Bajando la cuesta del siglo veinte, durante los años ochenta y noventa, el país volvió a vivir situaciones parecidas a las de Guadalupe Salcedo y sus camaradas del Llano. En el marco de las negociaciones y acuerdos de paz celebrados entre los gobiernos liberales y conservadores de la época con las guerrillas de las Farc, el Epl y el M-19, se dio la masacre de la Unión Patriótica, con dos candidatos presidenciales asesinados y miles de sus miembros sacrificados, lo que a la postre frustraría entonces las posibilidades de un acuerdo de paz con la organización de Manuel Marulanda Vélez. Lo mismo sucedió con la fracción del Epl que por esa época seguía a Oscar William Calvo. La muerte violenta de Carlos Pizarro, en campaña presidencial, estuvo a punto igualmente de malograr el acuerdo de paz recién celebrado por su organización y el gobierno de Barco.
Como la vez anterior, también ésta contó con la feroz resistencia de amplios sectores del establecimiento a la celebración de acuerdos con los alzados en armas que conlleven reformas al statu quo social y político. Detrás de las guerrillas trota la revolución social, fue la frase con la que el ex presidente López Pumarejo alertó en su momento sobre la necesidad de desmontar las guerrillas del Llano. Pero lo que en él podría ser una acertada previsión política, con la que justificaba la necesidad de una pronta y oportuna modernización de las estructuras económicas y sociales del sistema, para los sectores más retardatarios sería el grito de combate de los defensores acérrimos del orden. El mundo vivía entonces la época de la guerra fría y el fantasma del comunismo ya recorría estas tierras. A la postre, el grito de combate se haría dominante y hegemónico en el seno del establecimiento, frente a las veleidades modernizantes de algunos sectores políticos suyos. De ahí la feroz resistencia política y armada, legal e ilegal, institucional y extra institucional, cultural y mediática, con la que han sido recibidas las iniciativas de diversos gobiernos en los últimos sesenta años encaminadas a lograr una solución del conflicto armado interno por la vía de la negociación directa con los alzados en armas, con base en reformas políticas democráticas y el reconocimiento de un mínimo de justicia social.
No es extraño entonces que el acuerdo de paz celebrado en La Habana por el gobierno de Juan Manuel Santos y las Farc haya contado desde sus inicios con la oposición de diferentes sectores sociales, políticos y militares en retiro, de algunos medios de comunicación y comunidades religiosas. Estos mismos sectores lograron vencer, por un estrecho margen, al Gobierno y a los partidarios del acuerdo en la consulta plebiscitaria convocada por el Presidente de la República el 2 de octubre del año pasado. El Gobierno y las Farc debieron renegociar el acuerdo inicialmente celebrado, incorporando buena parte de los reparos y objeciones de los opositores, sin que ello lograra cesar los ataques y cuestionamientos al nuevo pacto de paz. Refrendado por el Congreso de la República, en su fase de implementación el acuerdo se ha encontrado con toda clase de obstáculos e impugnaciones. En la prensa y la plaza pública, así como en el Congreso y la Fiscalía General, retumba de nuevo el grito de combate que llama a cerrar filas en defensa del orden social, la propiedad privada y el honor de las Fuerzas Armadas. El propósito evidente es buscar el fracaso del acuerdo por la vía de impedir que se cumpla lo pactado.
La fase de implementación del acuerdo paz ha venido a coincidir con la fase final del gobierno Santos y el inicio de la campaña electoral para Congreso y Presidencia de la República. En este contexto, los primeros debates en el Congreso y los medios sobre el alcance y contenido de las reformas sociales, políticas e institucionales que buscan la ejecución del acuerdo darían lugar al inicio de una recomposición de la correlación de fuerzas sociales y políticas frente al mismo, dejando ver de paso que una cosa fue el consenso logrado por el Gobierno durante la fase de negociación del proceso de paz, y otra bien distinta es el reposicionamiento que han venido asumiendo diversos sectores en la fase de implementación y ejecución de lo acordado, cuando algunos de ellos comienzan a sopesar las implicaciones y consecuencias que se derivan de lo pactado. Lo que da cuenta no solo de lo hondo que ha calado entre el empresariado, los partidos políticos y las instituciones centrales del Estado, las objeciones y reparos que sistemáticamente le han formulado los enemigos iniciales de la paz al acuerdo finalmente negociado por el Gobierno y las Farc, sino también de la actitud refractaria que históricamente han sostenido los sectores hegemónicos del establecimiento. Factor decisivo en esta tendencia sería el reflujo en el que cayó la protesta y la movilización social de las organizaciones de izquierda, de trabajadores, jóvenes y mujeres que apoyaron el proceso de paz en la fase final de la negociación de los acuerdos.
Hoy es evidente que el Presidente de la república ha perdido la iniciativa, y que en el Gobierno no hay quien lidere el proceso ante el Congreso, la Rama Judicial y la opinión pública. La Unidad Nacional, esa fracción del partido del orden en la que Santos quiso apoyarse para sacar adelante el proceso de paz, amenaza con desmoronarse, acicateada por los cálculos electorales frente a la próxima campaña. Vargas Lleras, quien hasta hace poco fungió como Vicepresidente de Santos y ejecutor del más ambicioso plan gubernamental de infraestructura vial y vivienda popular, se fue del Gobierno con un portazo. Tanto él como su partido Cambio Radical decidieron darle la espalda a Santos, no sin antes apoderarse de la Presidencia de la Cámara de Representantes. Hoy hacen causa común con el partido de ex presidente Uribe en sus ataques al proceso de paz. Con la excepción de uno que otro vocero de la izquierda parlamentaria, el grueso de esta corriente en el Congreso aparece igualmente extraviada, sin poder acertar en los objetivos centrales de la coyuntura. Otro tanto ocurre en la Rama judicial con el Fiscal General de la Nación, quien en abierta rebeldía contra lo pactado en La Habana y en el Colón, se disputa públicamente la competencia de procesar judicialmente a los ex combatientes de la guerrilla, mientras la Corte Constitucional aparece errática en varios de sus pronunciamientos sobre la constitucionalidad de algunas piezas del proceso. Una franja importante de empresarios, que apoyó al Gobierno en la fase de la negociación, igualmente aparece hoy ante los medios objetando puntos esenciales de lo pactado con las Farc, como lo deja ver el más reciente pronunciamiento del Consejo Gremial Nacional.
Como consecuencia de todo esto, ni el Gobierno ni las Farc, tampoco la opinión pública, han logrado impedir que el acuerdo de paz esté siendo sometido a una renegociación en el seno del Congreso, de la que participan los ministros del gabinete, diferentes sectores políticos y el Fiscal General de la Nación, con el riesgo cierto de que a la postre, del Acuerdo Final quede apenas su sombra.
La implementación y ejecución del acuerdo de paz pasa pues por un momento lleno de contradicciones y vacilaciones por parte del Gobierno y las instituciones oficiales, con avances, retrocesos e incumplimiento de lo pactado. Siendo positivo que la Corte Constitucional haya decidido blindar el acuerdo de paz, al declarar la constitucionalidad del Acto legislativo 02 de 2017, que le confiere legitimidad formal al pacto, la verdad es que las piezas centrales del mismo se hallan en veremos. Así, por ejemplo, la reforma política acordada para que las Farc dieran el tránsito a la vida política legal se halla al borde del fracaso por evidente falta de voluntad política del Congreso y los partidos que lo controlan, lo que contrasta con la decisión del Consejo Nacional Electoral de otorgarle el reconocimiento de la personería jurídica al partido político constituido recientemente por los desmovilizados, luego de habérsela negado inicialmente. No menos preocupante es el estado en que se encuentra la institucionalidad y el funcionamiento de la Jurisdicción Especial de Paz, a punto de naufragar igualmente en medio del regateo, trabas y obstáculos de todo tipo por parte del Fiscal General, los gremios, los militares en retiro y los congresistas, cada cual tirando para su lado pero unidos en la pretensión de imponerle a los miembros de la Farc la condición de resolver previamente su situación judicial ante la JEP para poder participar en la actividad política. Ni qué hablar de la suerte que puedan correr los proyectos referidos a los programas de desarrollo agrario, zonas de reserva campesina y sustitución de cultivos ilícitos cuyo estudio y aprobación aparecen aplazadas indefinidamente. En estas condiciones, el proceso paz chapalea en manos del Gobierno y los congresistas, y amenaza con hacer crisis.
Lo que sucede hoy con el acuerdo de paz es la consecuencia no sólo de la falta de liderato del Presidente de la república en la gestión del mismo, sino también de la incapacidad de la izquierda y la opinión democrática de impedir que lo pactado haya sido sometido a una renegociación en el seno del Congreso. Yendo más atrás podría decirse que esta situación era previsible, y que la razón de todo ello radica en el hecho de haber aceptado que el Congreso de la República se constituyera en el escenario de debate y aprobación del paquete de reformas requerido para el desarrollo del Acuerdo de Paz, lo que sin duda alguna constituyó un grave error. De antemano se sabía que el Congreso es un escenario en el que se trafica con toda clase de intereses, en el que por lo demás los grandes terratenientes y ganaderos, así como los empresarios con intereses en la agroindustria, tienen un peso significativo. Sin contar que buena parte de los congresistas, ellos directamente o familiares suyos, han tenido nexos directos o indirectos con paramilitares y mafiosos. La alternativa de la Asamblea Constituyente con funciones legislativas, no fue lo suficientemente explorada entonces.
Desmovilizadas y desarmadas, convertidas hoy en partido político, con la expectativa de hacer el tránsito a la actividad política institucionalizada, la Farc percibe que un amplio sector del establecimiento pretende cerrarle las puertas y excluirla. La misma percepción se tiene en amplios sectores de la opinión pública, algunas agrupaciones de la izquierda, los trabajadores, campesinos, jóvenes y mujeres. Es una percepción que tiene como referente un hecho cierto y real: la burguesía y su clase política traman el incumplimiento del acuerdo de paz celebrado entre el Gobierno y las Farc. Por la vía de presionar la renegociación del mismo en el Congreso, se pretende limitar el alcance de las reformas sociales y políticas pactadas, buscando al mismo tiempo la mayor impunidad posible para los miembros de las Fuerzas Armadas y los terceros civiles (léase empresarios) responsables de delitos de lesa humanidad cometidos durante el conflicto. Presionadas a optar por una fuga hacia adelante, a la Farc parece no quedarle alternativa que insertarse en un sistema político desventajoso para la acción política institucional, basado en la simulación democrática de la competencia partidista. Como consecuencia de esto, es probable que tengan que enfrentar procesos de diferenciación política internos y enfrentar situaciones complejas que entrañen riesgos para la continuidad de su partido y la seguridad personal de sus dirigentes.
La maniobra en curso constituye sin duda una traición a lo pactado en La Habana y el Teatro Colón, y su gestación sobreviene tras haber logrado de la guerrilla su desmovilización y desarme anticipado. Y no es cierto que la misma comprometa únicamente a aquellos sectores que desde el principio aparecieron como enemigos de la paz negociada, de ella participan también Santos y buena parte de la élite empresarial y política que lo ha apoyado. De la felonía podrían derivarse beneficios adicionales. No es descartable que en la traición a la Farc el establecimiento halle la oportunidad de su reunificación, de suerte que lo que Santos no pudo en la fase de negociación del acuerdo, lo pueda el Congreso durante la implementación del mismo. Quedaría por seleccionar al gran timonel que con puño de acero y guante de seda conduzca y culmine la segunda parte de la opereta, si Vargas Lleras o el pupilo de Uribe.
Desde las épocas de Guadalupe Salcedo, la traición ha contado siempre con dos ingredientes, el incumplimiento del lo pactado por parte de las élites y la muerte violenta de los líderes guerrilleros. Por lo que se ve, el establecimiento sigue fiel a este patrón de conducta. Negociado el acuerdo de paz, la Farc no sólo enfrenta el desconocimiento de lo pactado, sino que además comienza a padecer los efectos del plomo enemigo entre sus filas: más de treinta de sus miembros han caído asesinados en diferentes lugares del país, todos ex guerrilleros de base, ningún líder de la organización todavía. Y por lo que igualmente se ve, no parece haber claridad, ni en la Farc ni el resto de la izquierda, sobre la estrategia política indicada para hacerle frente a la situación.
El acuerdo negociado por el gobierno de Santos y las Farc es un pacto político que sienta las bases de una paz real y posible, al tiempo que abre las puertas para que se hagan reformas de orden social, político e institucional encaminadas a democratizar la vida política nacional y a generar algunas mejoras en la forma de vida de amplios sectores sociales del campo. Tales reformas constituyen un programa de transformaciones democráticas de inmenso valor histórico y político, como quiera que frente a las mismas la sociedad colombiana registra un retraso estructural de muchísimos años. Pero, por la actitud del Gobierno y la reacción del establecimiento durante esta primera fase de implementación del acuerdo, surgen serias dudas de que las clases dominantes estén dispuestas a garantizar su ejecución. Le toca a la izquierda revolucionaria enfrentar las consecuencias políticas de esta realidad, sin autoengaños ni oportunismos. Y ello implica tener que replantearse el tema de la estrategia y la táctica política, buscando superar el infructuoso tacticismo coyuntural que conduce a la conciliación y la claudicación y que impide ver el horizonte que se extiende más allá de lo que es posible en lo inmediato.

La paz traicionada

El 6 de junio de 1957, en un suburbio del sur de Bogotá, cayó muerto Guadalupe Salcedo Unda. El Capitán, como se le conoció a Guadalupe, había sido el jefe máximo de las guerrillas liberales del Llano, un ejército de más 5000 campesinos levantados en armas contra la violencia conservadora tras el asesinato del caudillo liberal Jorge Eliécer Gaitán. Tres años antes, Guadalupe había firmado un acuerdo de paz con el gobierno del general Rojas Pinilla, acuerdo que incluía, aparte de la entrega de las armas, una amnistía general para los guerrilleros, así como reformas sociales y económicas en los territorios ocupados por los alzados en armas. Guadalupe Salcedo fue asesinado a mansalva por agentes de la policía, cuando ya se había incorporado a la vida civil y política. En el momento de su muerte acababa de salir de una reunión con antiguos compañeros suyos, evaluando estrategias conducentes a lograr el cumplimiento del acuerdo de paz celebrado.
Es probable que todavía muchos colombianos desconozcan el significado de toda esta historia: la muerte de Guadalupe vendría a sellar la traición del establecimiento no sólo al acuerdo celebrado con el jefe guerrillero, sino también a las expectativas de reformas sociales de miles de campesinos que se habían levantado en armas por la tierra y la paz. Desde entonces, el incumplimiento de los acuerdos celebrados, la felonía y el asesinato de dirigentes sociales y políticos de oposición se convirtió en un patrón de conducta de las clases y partidos dominantes en Colombia, marcando con ello una tradición que explica buena parte de la tragedia nuestra, detrás de la cual se esconden los intereses de aquellos sectores que viven del atraso y el conservadurismo cultural, social y político de la sociedad colombiana.
Bajando la cuesta del siglo veinte, durante los años ochenta y noventa, el país volvió a vivir situaciones parecidas a las de Guadalupe Salcedo y sus camaradas del Llano. En el marco de las negociaciones y acuerdos de paz celebrados entre los gobiernos liberales y conservadores de la época con las guerrillas de las Farc, el Epl y el M-19, se dio la masacre de la Unión Patriótica, con dos candidatos presidenciales asesinados y miles de sus miembros sacrificados, lo que a la postre frustraría entonces las posibilidades de un acuerdo de paz con la organización de Manuel Marulanda Vélez. Lo mismo sucedió con la fracción del Epl que por esa época seguía a Oscar William Calvo. La muerte violenta de Carlos Pizarro, en campaña presidencial, estuvo a punto igualmente de malograr el acuerdo de paz recién celebrado por su organización y el gobierno de Barco.
Como la vez anterior, también ésta contó con la feroz resistencia de amplios sectores del establecimiento a la celebración de acuerdos con los alzados en armas que conlleven reformas al statu quo social y político. Detrás de las guerrillas trota la revolución social, fue la frase con la que el ex presidente López Pumarejo alertó en su momento sobre la necesidad de desmontar las guerrillas del Llano. Pero lo que en él podría ser una acertada previsión política, con la que justificaba la necesidad de una pronta y oportuna modernización de las estructuras económicas y sociales del sistema, para los sectores más retardatarios sería el grito de combate de los defensores acérrimos del orden. El mundo vivía entonces la época de la guerra fría y el fantasma del comunismo ya recorría estas tierras. A la postre, el grito de combate se haría dominante y hegemónico en el seno del establecimiento, frente a las veleidades modernizantes de algunos sectores políticos suyos. De ahí la feroz resistencia política y armada, legal e ilegal, institucional y extra institucional, cultural y mediática, con la que han sido recibidas las iniciativas de diversos gobiernos en los últimos sesenta años encaminadas a lograr una solución del conflicto armado interno por la vía de la negociación directa con los alzados en armas, con base en reformas políticas democráticas y el reconocimiento de un mínimo de justicia social.
No es extraño entonces que el acuerdo de paz celebrado en La Habana por el gobierno de Juan Manuel Santos y las Farc haya contado desde sus inicios con la oposición de diferentes sectores sociales, políticos y militares en retiro, de algunos medios de comunicación y comunidades religiosas. Estos mismos sectores lograron vencer, por un estrecho margen, al Gobierno y a los partidarios del acuerdo en la consulta plebiscitaria convocada por el Presidente de la República el 2 de octubre del año pasado. El Gobierno y las Farc debieron renegociar el acuerdo inicialmente celebrado, incorporando buena parte de los reparos y objeciones de los opositores, sin que ello lograra cesar los ataques y cuestionamientos al nuevo pacto de paz. Refrendado por el Congreso de la República, en su fase de implementación el acuerdo se ha encontrado con toda clase de obstáculos e impugnaciones. En la prensa y la plaza pública, así como en el Congreso y la Fiscalía General, retumba de nuevo el grito de combate que llama a cerrar filas en defensa del orden social, la propiedad privada y el honor de las Fuerzas Armadas. El propósito evidente es buscar el fracaso del acuerdo por la vía de impedir que se cumpla lo pactado.
La fase de implementación del acuerdo paz ha venido a coincidir con la fase final del gobierno Santos y el inicio de la campaña electoral para Congreso y Presidencia de la República. En este contexto, los primeros debates en el Congreso y los medios sobre el alcance y contenido de las reformas sociales, políticas e institucionales que buscan la ejecución del acuerdo darían lugar al inicio de una recomposición de la correlación de fuerzas sociales y políticas frente al mismo, dejando ver de paso que una cosa fue el consenso logrado por el Gobierno durante la fase de negociación del proceso de paz, y otra bien distinta es el reposicionamiento que han venido asumiendo diversos sectores en la fase de implementación y ejecución de lo acordado, cuando algunos de ellos comienzan a sopesar las implicaciones y consecuencias que se derivan de lo pactado. Lo que da cuenta no solo de lo hondo que ha calado entre el empresariado, los partidos políticos y las instituciones centrales del Estado, las objeciones y reparos que sistemáticamente le han formulado los enemigos iniciales de la paz al acuerdo finalmente negociado por el Gobierno y las Farc, sino también de la actitud refractaria que históricamente han sostenido los sectores hegemónicos del establecimiento. Factor decisivo en esta tendencia sería el reflujo en el que cayó la protesta y la movilización social de las organizaciones de izquierda, de trabajadores, jóvenes y mujeres que apoyaron el proceso de paz en la fase final de la negociación de los acuerdos.
Hoy es evidente que el Presidente de la república ha perdido la iniciativa, y que en el Gobierno no hay quien lidere el proceso ante el Congreso, la Rama Judicial y la opinión pública. La Unidad Nacional, esa fracción del partido del orden en la que Santos quiso apoyarse para sacar adelante el proceso de paz, amenaza con desmoronarse, acicateada por los cálculos electorales frente a la próxima campaña. Vargas Lleras, quien hasta hace poco fungió como Vicepresidente de Santos y ejecutor del más ambicioso plan gubernamental de infraestructura vial y vivienda popular, se fue del Gobierno con un portazo. Tanto él como su partido Cambio Radical decidieron darle la espalda a Santos, no sin antes apoderarse de la Presidencia de la Cámara de Representantes. Hoy hacen causa común con el partido de ex presidente Uribe en sus ataques al proceso de paz. Con la excepción de uno que otro vocero de la izquierda parlamentaria, el grueso de esta corriente en el Congreso aparece igualmente extraviada, sin poder acertar en los objetivos centrales de la coyuntura. Otro tanto ocurre en la Rama judicial con el Fiscal General de la Nación, quien en abierta rebeldía contra lo pactado en La Habana y en el Colón, se disputa públicamente la competencia de procesar judicialmente a los ex combatientes de la guerrilla, mientras la Corte Constitucional aparece errática en varios de sus pronunciamientos sobre la constitucionalidad de algunas piezas del proceso. Una franja importante de empresarios, que apoyó al Gobierno en la fase de la negociación, igualmente aparece hoy ante los medios objetando puntos esenciales de lo pactado con las Farc, como lo deja ver el más reciente pronunciamiento del Consejo Gremial Nacional.
Como consecuencia de todo esto, ni el Gobierno ni las Farc, tampoco la opinión pública, han logrado impedir que el acuerdo de paz esté siendo sometido a una renegociación en el seno del Congreso, de la que participan los ministros del gabinete, diferentes sectores políticos y el Fiscal General de la Nación, con el riesgo cierto de que a la postre, del Acuerdo Final quede apenas su sombra.
La implementación y ejecución del acuerdo de paz pasa pues por un momento lleno de contradicciones y vacilaciones por parte del Gobierno y las instituciones oficiales, con avances, retrocesos e incumplimiento de lo pactado. Siendo positivo que la Corte Constitucional haya decidido blindar el acuerdo de paz, al declarar la constitucionalidad del Acto legislativo 02 de 2017, que le confiere legitimidad formal al pacto, la verdad es que las piezas centrales del mismo se hallan en veremos. Así, por ejemplo, la reforma política acordada para que las Farc dieran el tránsito a la vida política legal se halla al borde del fracaso por evidente falta de voluntad política del Congreso y los partidos que lo controlan, lo que contrasta con la decisión del Consejo Nacional Electoral de otorgarle el reconocimiento de la personería jurídica al partido político constituido recientemente por los desmovilizados, luego de habérsela negado inicialmente. No menos preocupante es el estado en que se encuentra la institucionalidad y el funcionamiento de la Jurisdicción Especial de Paz, a punto de naufragar igualmente en medio del regateo, trabas y obstáculos de todo tipo por parte del Fiscal General, los gremios, los militares en retiro y los congresistas, cada cual tirando para su lado pero unidos en la pretensión de imponerle a los miembros de la Farc la condición de resolver previamente su situación judicial ante la JEP para poder participar en la actividad política. Ni qué hablar de la suerte que puedan correr los proyectos referidos a los programas de desarrollo agrario, zonas de reserva campesina y sustitución de cultivos ilícitos cuyo estudio y aprobación aparecen aplazadas indefinidamente. En estas condiciones, el proceso paz chapalea en manos del Gobierno y los congresistas, y amenaza con hacer crisis.
Lo que sucede hoy con el acuerdo de paz es la consecuencia no sólo de la falta de liderato del Presidente de la república en la gestión del mismo, sino también de la incapacidad de la izquierda y la opinión democrática de impedir que lo pactado haya sido sometido a una renegociación en el seno del Congreso. Yendo más atrás podría decirse que esta situación era previsible, y que la razón de todo ello radica en el hecho de haber aceptado que el Congreso de la República se constituyera en el escenario de debate y aprobación del paquete de reformas requerido para el desarrollo del Acuerdo de Paz, lo que sin duda alguna constituyó un grave error. De antemano se sabía que el Congreso es un escenario en el que se trafica con toda clase de intereses, en el que por lo demás los grandes terratenientes y ganaderos, así como los empresarios con intereses en la agroindustria, tienen un peso significativo. Sin contar que buena parte de los congresistas, ellos directamente o familiares suyos, han tenido nexos directos o indirectos con paramilitares y mafiosos. La alternativa de la Asamblea Constituyente con funciones legislativas, no fue lo suficientemente explorada entonces.
Desmovilizadas y desarmadas, convertidas hoy en partido político, con la expectativa de hacer el tránsito a la actividad política institucionalizada, la Farc percibe que un amplio sector del establecimiento pretende cerrarle las puertas y excluirla. La misma percepción se tiene en amplios sectores de la opinión pública, algunas agrupaciones de la izquierda, los trabajadores, campesinos, jóvenes y mujeres. Es una percepción que tiene como referente un hecho cierto y real: la burguesía y su clase política traman el incumplimiento del acuerdo de paz celebrado entre el Gobierno y las Farc. Por la vía de presionar la renegociación del mismo en el Congreso, se pretende limitar el alcance de las reformas sociales y políticas pactadas, buscando al mismo tiempo la mayor impunidad posible para los miembros de las Fuerzas Armadas y los terceros civiles (léase empresarios) responsables de delitos de lesa humanidad cometidos durante el conflicto. Presionadas a optar por una fuga hacia adelante, a la Farc parece no quedarle alternativa que insertarse en un sistema político desventajoso para la acción política institucional, basado en la simulación democrática de la competencia partidista. Como consecuencia de esto, es probable que tengan que enfrentar procesos de diferenciación política internos y enfrentar situaciones complejas que entrañen riesgos para la continuidad de su partido y la seguridad personal de sus dirigentes.
La maniobra en curso constituye sin duda una traición a lo pactado en La Habana y el Teatro Colón, y su gestación sobreviene tras haber logrado de la guerrilla su desmovilización y desarme anticipado. Y no es cierto que la misma comprometa únicamente a aquellos sectores que desde el principio aparecieron como enemigos de la paz negociada, de ella participan también Santos y buena parte de la élite empresarial y política que lo ha apoyado. De la felonía podrían derivarse beneficios adicionales. No es descartable que en la traición a la Farc el establecimiento halle la oportunidad de su reunificación, de suerte que lo que Santos no pudo en la fase de negociación del acuerdo, lo pueda el Congreso durante la implementación del mismo. Quedaría por seleccionar al gran timonel que con puño de acero y guante de seda conduzca y culmine la segunda parte de la opereta, si Vargas Lleras o el pupilo de Uribe.
Desde las épocas de Guadalupe Salcedo, la traición ha contado siempre con dos ingredientes, el incumplimiento del lo pactado por parte de las élites y la muerte violenta de los líderes guerrilleros. Por lo que se ve, el establecimiento sigue fiel a este patrón de conducta. Negociado el acuerdo de paz, la Farc no sólo enfrenta el desconocimiento de lo pactado, sino que además comienza a padecer los efectos del plomo enemigo entre sus filas: más de treinta de sus miembros han caído asesinados en diferentes lugares del país, todos ex guerrilleros de base, ningún líder de la organización todavía. Y por lo que igualmente se ve, no parece haber claridad, ni en la Farc ni el resto de la izquierda, sobre la estrategia política indicada para hacerle frente a la situación.
El acuerdo negociado por el gobierno de Santos y las Farc es un pacto político que sienta las bases de una paz real y posible, al tiempo que abre las puertas para que se hagan reformas de orden social, político e institucional encaminadas a democratizar la vida política nacional y a generar algunas mejoras en la forma de vida de amplios sectores sociales del campo. Tales reformas constituyen un programa de transformaciones democráticas de inmenso valor histórico y político, como quiera que frente a las mismas la sociedad colombiana registra un retraso estructural de muchísimos años. Pero, por la actitud del Gobierno y la reacción del establecimiento durante esta primera fase de implementación del acuerdo, surgen serias dudas de que las clases dominantes estén dispuestas a garantizar su ejecución. Le toca a la izquierda revolucionaria enfrentar las consecuencias políticas de esta realidad, sin autoengaños ni oportunismos. Y ello implica tener que replantearse el tema de la estrategia y la táctica política, buscando superar el infructuoso tacticismo coyuntural que conduce a la conciliación y la claudicación y que impide ver el horizonte que se extiende más allá de lo que es posible en lo inmediato.
ASÍ QUE VUELVO A EMPEZAR POR SEÑALAR – YENDO AL NUDO GORDIANO DEL ASUNTO Y MUCHO MÁS ALLÁ DE LA MERA HERMENÉUTICA JURÍDICA DEL TEXTO CONSTITUCIONAL SOMETIDO A EXAMEN DE LA CORTE CONSTITUCIONAL A LA LUZ – EXCLUSIVAMENTE – DE CÓDICES INTERNACIONALES – LA PROFUNDA INCERTIDUMBRE, DESCONFIANZA Y GRAN EXTRAÑEZA QUE ESTÁ CAUSANDO ENTRE LA OPINIÓN PUBLICA YA DE POR SÍ MUY MAL INFORMADA Y POLARIZADA POR LOS MEDIOS DE COMUNICACIÓN MASIVA DE PRENSA, RADIO, TELEVISIÓN, PARTIDOS POLITICO-RELIGIOSOS CON ASIENTO EN EL CONGRESO, – ENTRE LOS 'BUENAZOS EN EL GOBIERNO Y SUS FUERZAS MILITARES Y LOS 'MALOS CRIMINALES DE LA IZQUIERDA TERRORISTA'-, LA FALTA DE UNA MUY IMPORTANTE Y NECESARIA CONTEXTUALIZACIÓN HISTÓRICA DE LA QUE ADOLECE EL CANDENTE Y CADA VEZ MÁS AGRIO Y ACALORADO DEBATE POLÍTICO GUBERNAMENTAL, ACADÉMICO, DEL CONGRESO Y DE LAS ALTAS CORTES SOBRE EL PROCESO DE PAZ, EN YA MUY ACCIDENTADO Y POLARIZADO CURSO QUE AFECTA GRAVEMENTE LA ESTABILIDAD DEL MISMO Y DE LAS INSTITUCIONES PÚBLICAS QUE DEBEN OPERACIONALIZARLO:

APROVECHANDO EN SU FAVOR LA COYUNTURA HISTÓRICA PRECISAMENTE DEL TAN CUESTIONADO PROCESO DE PAZ POR ELLOS MISMOS CON LA INSURGENCIA, PUES,
(2) ¡HAN SOLICITADO ENTRE LOS PRIMEROS, SIN ESCRÚPULO ALGUNO, SU INGRESO TODOS ELLOS A LA JUSTICIA TRANSICIONAL
